If you have been reading the e-bike news, you’ve likely seen the headlines about New York City. NYC officially introduced a citywide speed cap for e-bikes and e-scooters. If you’re riding on bike lanes, it’s limited to 15 mph. You’re allowed to ride your bikes on street lanes as long as the street mph limit is 30 or less. And sidewalks are strictly banned, meant for walking pedestrians. Apparently, this will be backed by NYPD checkpoints and increased scrutiny on over-powered, high-speed builds.

There are other rules, but those are similar to what we should already be aware of in the NoVA and DMV area, such as motors have to be under 750 watts, all e-bikes must have functioning pedals and meet the classifications in that jurisdiction.

For commuters and trail riders across our area, people are wondering, is Virginia headed down the same path? If you’ve been hearing news, there are more people riding e-bikes, old and young. There have been some unfortunate news as the industry and sport grows. I am sure there are complaints everywhere regarding the dangers and what lawmakers want to do in order to curb the accidents.

Here is a breakdown of how Virginia law compares to NYC’s restrictive urban policies, how local park authorities govern our popular commuter trails, and why custom conversion builds give you the ultimate edge in staying fast, compliant, and hill-ready.

NYC’s Crackdown vs. Virginia State Law

To understand where Virginia stands, it helps to look at why New York City acted so aggressively. NYC’s 15 mph blanket cap was designed for an intensely dense urban environment where high-speed delivery riders, crowded crosswalks, and narrow bike lanes created constant friction with pedestrians.

Virginia, by contrast, relies on the standard three-class e-bike framework under state code:

Class 1: Pedal-assist only, motor stops assisting at 20 mph.

Class 2: Throttle-assisted, motor stops assisting at 20 mph.

Class 3: Pedal-assist only, motor stops assisting at 28 mph.

On public roads and dedicated on-street bike lanes throughout Virginia, Class 1 and Class 2 e-bikes are legally treated like traditional bicycles, while Class 3 e-bikes provide commuters with enough speed to keep pace with traffic on roads posted up to 35 mph, this is important, remember this.

While Virginia is unlikely to adopt NYC’s citywide 15 mph street cap anytime soon, the rules change significantly the moment you front-wheel off the asphalt and onto our regional multi-use trail networks.

Local NoVA Trail Rules: W&OD, Mount Vernon, and Custis

Washington & Old Dominion (W&OD) Trail

Governing Body: NOVA Parks

E-Bike Rule: Class 1 and Class 2 e-bikes (capped at a maximum powered speed of 20 mph are fully permitted.

Key Detail: Any electric conveyance designed or modified to assist past 20 mph under motor power is explicitly prohibited on the W&OD. High-speed “emoto” style builds modified for 35 mph will quickly draw park ranger attention.

Mount Vernon Trail

Governing Body: National Park Service (George Washington Memorial Parkway)

E-Bike Rule: The National Park Service imposes a strict 15 mph speed limit on designated trail sections.

Key Detail: NPS regulations require riders to pedal continuously when motor assistance is engaged on multi-use paths. Throttle-only cruising without pedaling is prohibited on Mount Vernon Trail paths. Courtesy is enforced—blind curves around bridge overpasses require dropping speeds well below 15 mph.

When news breaks about e-bike speed crackdowns, riders often worry that custom builds or higher-voltage systems will be targeted. A common misconception is that upgrading to a 52V system is all about breaking trail speed limits.

Vice versa, typically after a large accident on the news, the community rallies around safety. As they should. However, this may come as a surprise to many people, Northern Virginia and the DC metro area, is NOT New York City. Shocker! I know. There are many different types of riders in this area, there are many reasons why people ride bikes, e-bikes, scooters, etc., and there are many different terrains. This area is much wider and we have trails that run for miles. What I am trying to say is that we have old folks trying to stay in shape, whether they’re actively trying to get into better shape or stay active, working their way out of an injury, people just want to ride a couple minutes to a couple miles and then return home. Then we have young early professionals or people who go from Falls Church to DC every day. For some people, a Class 1 is great, they want to get healthy, it’s perfect. For those who need to keep up with traffic, Class 3 allows them to do that. Our take is that everyone should be allowed to ride a bike, but just like there is only one road, we need to share it and acknowledge that there are others. Some people don’t want to you to ride your bike so fast on trails and others want you off their public street roads because they’re late for work. I recommend that you build the bike that keeps you the safest, and always, ALWAYS, put yourself in a position that allows you to ride another day.

So will Virginia follow NYC’s 15 mph street caps? We don’t think so, like we said before, this area is much wider and different compared to a large city like New York. It is unlikely for road travel, but with everything going on lately, we understand there needs to be changes, especially for the youth who are interested in speed so it’s expected that local enforcement on regional trails is already tightening up against reckless speed.

The best way to protect our riding privileges across NoVA is simple:

1. Respect trail caps: Keep it under 15 mph on crowded paths like the Mount Vernon Trail and cap assist at 20 mph on the W&OD.

2. Pedal on trails: Keep your cadence active, especially on NPS land.

3. Build smart: Focus on modular power, torque efficiency, and heat management rather than raw top speed.

Our Obligatory Way to Keep the Lights On

So we’ve gone over the safety comparisons, we have gone over the unique trails around the area, and some of the tips we recommend about general caution when riding an e-bike or any bike, for that matter.
